New Laws in Colorado Governing Attorney Fees in Bad Faith Insurance Matters

Recently, Colorado passed new statutes addressing insurance claims and attorney fees and how they are to be paid when an insurance company acts in bad faith by unreasonably delaying or denying your claim. When an insurance claim has been denied in bad faith or unreasonably delayed, an individual or business (called the first-party claimant) may be entitled to recover for the consequences that result from the denial or delay, including:

  • Two times the covered benefit
  • Reasonable attorney fees
  • Court costs

This is an important change for those considering filing an insurance claim. Now, under new Colorado law, you may be able to recover attorney fees.
